The ABC School Board may not have followed the proper guidelines reagarding the resignation of a former school board member.California Education Code: Subsection 35178 Filling a Board Vacancy/Eligible Voting Participants ss 35178. "A member of the governing board of a school district who has tendered a resignation with a deferred effective date pursuant to Section 5090 shall, until the effective date of the resignation, continue to have the right to exercise all powers of a member of the governing board, except that such member shall not have the right to vote for his or her successor in an action taken by the board to make a provisional appointment pursuant to Section 5091." Today's ABC questions: Didn't a now former ABC School Board Member cast the deciding vote (4 to 3) that allowed his replacement to be "Appointed" by the ABC School Board BACK on March 1st, 2005? Didn't that same former member participate in four total votes during this critical debate that resulted in the appointment of a "provisional Member" to serve as a full voting member of the ABC SCHOOL BOARD? Didn't one of Member of the ABC School Board sell that same ABC School Board Members' Cerritos home for $859,000 in July, 2004? According to documents from her own website that was exactly what occured. I think that is a poor use of ones elective office. Don't you? Why didn't the LA County Office of Education investigate this matter when it had the facts of the case? Tens of thousands of dollars in profits off of the sale of a fellow board member's home with whom you serve is not allowed under California Election and Criminal laws. I want a School Board that is above the law....not in violation of the law. Why did my other ABC School Board Members silent on this "non-resident issue?" Is this acceptable behavior of elected officials? I say no, and it must stop and never allowed to occur ever again. The good hard working people of Cerritos, Artesia, Hawaiian Gardens, Lakewood, and Norwalk deserve the truth about it's elected officials. That's why I'm running to stop this game of political free wheeling and dealing and profiting at the expense of our chidlren. I believe in a school board that obeys the ABSOLUTE letter of the law, in a Board that does not act outside of the laws of the State of California. The ABC School Board has "Board By-Laws" which have nothing to do with State Education Codes and California Laws. Did you know the ABC School Board actually can place another member under "a trial" if they don't "conduct Good-Boardsmanship." Huh? What about the law. The California Education Code is the law...I entend to follow these laws when elected to serve. This election is about fixing the problem. Played their game of blame long enough. It's time for the real truth to be told...and the voters of ABC are the final judge and jury on election day. This saga in the ABC Soap Opera needs to come to a finale. November 8, 2005 is Curtain Call for America's Worst School Board....A B C....see ya! Randy Economy |
