A YES vote on this measure means:
A "yes" vote is a vote to amend Article VIII, Section 800, of the City Charter of the City of Sunnyvale.

A NO vote on this measure means:
A "no" vote is a vote to not amend Article VIII, Section 800, of the City Charter of the City of Sunnyvale.

Impartial Analysis from the City Attorney
California law permits amendment of the City Charter for the City of Sunnyvale if the amendment is approved by a majority of the voters in the city voting at an election.

Article VIII, Section 800, of the City Charter of the City of Sunnyvale provides that the city manager is not required to be a resident of the State of California or City of Sunnyvale at the time of appointment, but shall reside within the City of Sunnyvale while serving as city manager.

The California Constitution was amended in 1976, Article XI, Section 10(b), to prohibit cities, including charter cities, from requiring that employees be residents of the city. A city can, however, require employees to reside within a reasonable and specific distance from the place of employment.

The Sunnyvale City Council proposes amending Article VIII, Section 800, to delete the requirement that the city manager reside within the City of Sunnyvale during his/her term of office to comply with the California Constitution.

A "yes" vote is a vote to amend Article VIII, Section 800, of the City Charter of the City of Sunnyvale.

A "no" vote is a vote to not amend Article VIII, Section 800, of the City Charter of the City of Sunnyvale.

If Charter Amendment G carries, Article VIII, Section 800 of the Charter of the City of Sunnyvale shall be amended to read as follows:

Article VIII, City Manager. Section 800. Appointment.

The City Manager shall be chosen by the City Council on the basis of his/her executive and administrative qualifications , but need not be a resident of the City or State at the time of his/her appointment, but he/she shall reside within the City during his/her tenure of office. No City Councilmember shall receive such an appointment to the office of City Manager during the term for which he/she shall have been elected, nor within two years thereafter.
