Shall the Mountain House Community Services District have an elected board of directors with the members of the board of directors being elected at-large?
California Government Code Section 61029 provides that the Board of Supervisors of the County of San Joaquin shall be the Board of Directors of the MHCSD. Section 61029 further provides that, upon certification of the Registrar of Voters that the number of voters in the MHCSD has reached or exceeded 1,000, the Board of Supervisors of the County of San Joaquin shall adopt a resolution placing the question of having an independently elected board of directors of the ballot. On or about May 3, 2007, the Registrar of Voters certified in writing that the numbers of voters in the MHCSD had reached or exceeded 1,000. On or about July 10, 2007, the Board of Supervisors of the County of San Joaquin adopted Resolution No. R-07-403, calling an election on the question of having an independent elected board of directors for the MHCSD and specifying that the directors be elected at large. Measure P requires approval by a majority of voters voting upon the question. If passed, Measure P will authorize the election of an independent five-member board of directors for the MHCSD at the next general district election in November 2008. There will be no additional assessment or increase in taxes resulting from Measure P. The conduct of this election will be in conformity with existing laws of the State of California and will not otherwise affect existing law.

BEFORE THE BOARD OF SUPERVISORS OF THE COUNTY OF SAN JOAQUIN, STATE OF CALIFORNIA
Resolution No. R-07-403 RESOLUTION CALLING AN ELECTION ON THE QUESTION OF WHETHER THE MOUNTAIN HOUSE COMMUNITY SERVICES DISTRICT SHALL HAVE AN INDEPENDENT BOARD OF DIRECTORS WHEREAS, Section 61029 of the Community Services District Law requires the Board of Supervisors to adopt a resolution placing the question of whether the Mountain House Community Services District shall have an independent board of directors when the Registrar of Voters certifies in writing that the number of voters has reached or exceeded 1000 voters; and WHEREAS, on May 3, 2007, the Registrar of Voters certified in writing that the number of voters has reached or exceeded 1000 voters; and WHEREAS, the Community Services District Law requires the resolution to specify from where the board of directors will be elected, at large, by divisions, or from divisions; and WHEREAS, the Ad Hoc Advisory Community recommended that the directors be elected at-large; and WHEREAS, the measure shall read: Shall the Mountain House Community Services District have an elected board of directors with the members of the board of directors being elected at-large?
YES NOW, THEREFORE, BE IT RESOLVED this Board of Supervisors call an election on the above measure to be conducted on Tuesday November 6, 2007. BE IT FURTHER RESOLVED that the Registrar of Voters is directed to conduct the election. PASSED AND ADOPTED this 10th day of July, 2007, by the following vote of the Board of Supervisors of the County of San Joaquin, to wit: AYES: Vogel, Ruhstaller, Ornellas, Gutierrez, Mow NOES: None ABSENT: None
